Petition Text:The criteria in order to qualify for tax relief under this scheme, you must hold a valid Primary Medical Certificate. A Primary Medical Certificate confirms you are severely and permanently disabled and is only issued to persons that satisfy the criteria (see below for criteria) as laid down in the legislation (Disabled Drivers and Disabled Passengers (Tax Concessions) Regulations 1994 (SI No. 353/1994)). This criteria needs to be modified to take into account persons who are missing both a hand and an arm. The criteria as stated is discrimatory on the following basis- A) It treats the arm and hand as separate entities but only where they are on different limbs. i.e 2 hands missing or 2 arms. B) Where one lower limb is missing there is automatic qualification for this scheme. Modification of a vehicle to adapt to the requirement of a single lower limb is less significant than a missing hand and arm. Automatic modern vehicles will cater for one missing lower limb without adaptation whereas a missing arm and hand requires varied adaptations for lights, wipers, steering etc in addition to requiring an automatic vehicle. The criteria does not consider the requirements of individuals where both a hand and an arm are missing. As the criteria is written, it would appear that the legislation never catered for and assumed that persons missing an upper limb could never drive a vehicle which is not the case.
