Petition Text: | 102.— (1) The Garda Commissioner shall refer to the Ombudsman Commission any matter that appears to the Garda Commissioner to indicate that the conduct of a member of the Garda Síochána may have resulted in the death of, or serious harm to, a person.
This section needs to be amended in light of the death of Sergeant Micheal Galvin. The words "may have" must be amended to "has". This will reduce the unnecessary referrals from District Officers to GSOC.
(4) The Ombudsman Commission may, if it appears to it desirable in the public interest to do so and without receiving a complaint, investigate any matter that appears to it to indicate that a member of the Garda Síochána may have—
(a) committed an offence, or
(b) behaved in a manner that would justify disciplinary proceedings.
In relation to the above section the wording of this must be amended from "may have" to "has" will be fair , transparent to all involved. |
