Petition Text:Dear Members of the Committee, I would like to draw your attention to the Unconstitutionality of the Courts Bill 2016. You will be told that the aim of the Bill is to help struggling homeowners. That is an untruth. The aim of the Bill is to enable the Banks to maintain proceedings in the Circuit court which summarily swing the axe on homeowners. State Owned banks have no interest offering solutions to their customers. They are more interested in the tax write offs and cashing in an idemnity Bond once an order is obtained from Court. The Circuit Court is a cost effective way for them to do this and further the Judges of Circuit Court do not have sufficient epertise. The poor people have no effective legal representation to defend them. The Bill is unconstitutional insofar as it deems to retrospectively change the Rights of Citizens and Consumers with regards to teh legal rights. It is an unjust attack on their property rights by changing the goal posts. The Courts in East Donegal V Attorney general held that there is a presumption that the Oireachtas acts constitutionally implementing legislation. If you passed this legislation as it currently stand s you would be acting unconstitutionally. In particular the restrospective nature of Section 2 (b) is striking.
