Petition Text:Government policy of tendering out the new Social Inclusion and Community Activation Programme (SICAP) threatens to undermine and potentially damage community development and local community projects. We contend it will result in a deterioration of services for the most disadvantaged. In February 2014, the Department of Environment stated on advice from the AG, ‘the guidance provided strongly indicates that the new Programme will be subject to the EU procurement Directive 2004/18/EC, furthermore and related to the requirement to comply with tendering obligations. ‘ The department cited Directive 2004/18/EC as the basis for SICAP to be put out to tender. This directive was repealed by Directive 2014/24/EU on 26 February 2014. European Directive 2014/24/EU is now the current legal position on public procurement. Directive 2014/24/EU states, (in preamble 7) the directive is without prejudice to the freedom of member national, regional and local authorities to provide, commission and finance services that pursue public policy objectives and which specifies that the directive does not apply to systems of grant aid in particular in the social field. Preamble 114 stated that member states and public authorities remain free to organise social services in which a way that does not entail the conclusion of public contracts. Therefore, SICAP does not need to go to tender. Ireland is the only EU country to put its community development programme out to public tender. If SICAP is run for profit the most disadvantaged will lose, the State will pay more and services will deteriorate.
