Téacs na hAchainí: | That the Oireachtas should make provision for compensation of injured parties (passengers or general public) in Air Accidents where insurance has been repudiated or where the aircraft operator was uninsured. There is currently no equivalent of the Motor Insurers Bureau of Ireland when it comes to aviation. The EU Motor Insurance directive requires member States to do this in relation to victims of uninsured motorists but the EU Aviation Insurance Regulation makes no such provision for victims of uninsured aviators. Also this Regulation has never been transposed into Irish Law. This could be done by simply extending the existing agreements between the Government and the Irish Insurance Industry to cover aviation. Also requesting that Section 20 of the Air Navigation (Operations) Order 1964 be amended to include insurance certificate in the list of documents which must be carried on board aircraft in flight. A further request would be to make it compulsory for the Irish Aviation Authority (IAA) to respond to Safety Recommendations (SRs) issued by the Air Accident Investigation Unit (AAIU) and within a specified time limit. Currently the greatest number of unanswered SRs issued by the AAIU, are those addressed to the IAA. |
